Sports gambling was illegal in most of the United States until May 2019, when the US Supreme Court overturned the Professional and Amateur Sports Protection Act 1992 (PASPA). That landmark ruling ended a decades-long prohibition era and paved the way for states to legalise, tax and regulate sports betting as they saw fit.

Indiana was one of several states to approve sports betting legislation in May 2019 – a year after PASPA lifted the nationwide ban. According to Section 35-45-5-2 of the Indiana Code it defines unlawful gambling as a person who knowingly or intentionally engages in gambling that is “risking money or other property for gain, contingent in whole or in part upon lot, chance, or the operation of a gambling device.” It is a Class B misdemeanor. There is a Class D felony according to IC 35-45-5-4 in terms of promoting professional gambling.

The Indiana Horse Racing Commission oversees and regulates the two racetracks in the state and makes sure the tracks adhere to the rules of racing, while the Indiana Gaming Commission looks after casino gaming, lotteries and sports wagering.
